Rights of the Staff Delegation Webinar

The social elections have taken place on 12 March 2024 and the newly elected delegations will formally start their work in the coming weeks. A lot of players in the private capital world will be faced with staff representation questions for the first time. Others may have prior experience but would welcome a refresh of dos and don’ts. That is what our seminar is geared at.
We will describe the functioning of the delegation and touch on the following questions:
– How do they meet?
– How often does the employer need to meet with them?
– What levels of involvement can the delegation have (co-decision, information / consultation or simple information)?
We will also outline some of the rights the staff delegation has on precise topics such as:
– Changes in the equipment and in the location
– Information / consultation on matters that have an economic relevance
– Dismissals
– Transfer of employees etc.
We will look particularly at all topics with a co-decision right.
Finally, we will describe the staff delegation’s particular status and rights, such as:
– Staff delegation hours
– Training rights
– Protection against dismissal
– Rights to communicate with staff.
The description of legal rules will be led by Gilles Dall’Agnol (Allen & Overy), with practical insides and experiences shared by Daphné Rosseeuw (DLA Piper).
